Two Rape Suspects Arrested

On September 20, 2006 at approximately 10:25 AM/CST, the Lee County Sheriff's Office arrested Travis Battle, age 33, of Opelika, on one count of Rape in the Second Degree for an alleged incident that was reported on June 27, 2006.  The victim in this case was a thirteen year old female.

On September 20, 2006 at approximately 12:45 PM/CST, the Lee County Sheriff's Office arrested Thomas Stanley, age 24, of Opelika, on one count of Rape in the Second Degree for an alleged incident that was reported on September 17, 2006.  The victim in this case was a fifteen year old female who had been reported as a runaway.

These cases were not related.

The charge of Rape in the Second Degree is a class B felony.  The Alabama Criminal Code defines the charge of Rape in the Second Degree as follows:

(1) Being 16 years old or older, he or she engages in sexual intercourse with a member of the opposite sex less than 16 and more than 12 years old; provided, however, the actor is at least two years older than the member of the opposite sex.

(2) He or she engages in sexual intercourse with a member of the opposite sex who is incapable of consent by reason of being mentally defective.
